The following policy applies to e-commerce on the site alfavit.eu (hereinafter referred to as AlfaVit) in the Internet. AlfaVit retains the right to amend it's policy without prior notice. Before placing an order the Customer shall acquaint himself with the terms of use currently in force. For periodicals subscription rules see item Terms of subscriptions.
1. General policy
When placing an order, the Customer accepts this policy for shipment to Poland and abroad. AlfaVit only sells goods to private persons of age and to corporate bodies. Sale to a person under age is possible under conditions that his custody gives a written permission by e-mail or by fax to the purchase of goods.
2. Registration
2.1 In e-commerce orders are accepted by AlfaVit only from a registered Customer. A private Customer should give his credentials (name, address, telephone number and e-mail address; a corporate Customer shall also note his business ID). AlfaVit shall not transfer Customer information to anyone except members of the same group of companies or as required by law. According to the law on personal information, any Customer has the right to check his individual information in the register. Only the name, address, telephone, email-address, user code and password are registered in the Customer register. The Customer register is kept by AlfaVit's Customer service.
2.2 The Customer's order information and purchase history are protected by the choose password. The Customer is asked to store the password in secrecy in order to prevent any outsider to get access to this information.
3. Prices
3.1 The price currently in force is the price indicated in AlfaVit's price list at the moment of placing the order, to be found at alfavit.com. All prices are VAT-inclusive
3.2 Delivery expenses shall be added to all mail deliveries according to the way of shipping chosen by the Customer. AlfaVit's Customer service shall ship the goods in one or several parties whereas delivery cost shall usually be charged only once.
3.3 Customs Charges. If you are ordering goods for delivery outside of Poland, please note that your consignment may be subject to import duties and taxes, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be paid by you. It is accepted by you that AlfaVit has no control over additional charges in relation to customs clearance. AlfaVit recommend that you check with your local customs officials or post office for more information regarding importation taxes/duties that may be applicable to your online order. You will be the importer of record and responsible for any import VAT and duty that needs to be paid. In addition, any charges for import clearance will be paid by the customer.
4. Terms of payment
4.1 At AlfaVit's web-store user pays via a Polish third-party company DotPay, which accepts payments with Visa, MasterCard/Eurocard (Credit/Debit), Visa Electron and Diners or the international online payment systems PayPal. Both corporate customers and individuals may be invoiced.
4.2 When making a purchase, the Customer is transferred to the web payment service of the matching payment accepting company. Only the information on the accepted/rejected payment and the payment date reaches AlfaVit. AlfaVit doesn't have access to any credit card information when payments are processed at the webstore.
4.3 If the delivery takes place against invoice, the term of payment shall be fourteen (14) days from the date of the invoice, if not otherwise agreed between the Customer and AlfaVit. When effecting payment, always state the reference number.
5. Delivery (shipment)
5.1 Since the books and other goods sold by AlfaVit as a rule are not of Polish origin, the term of delivery may vary from 2 to 20 working days, depending on whether the book/item is in stock or not. All the delivery times indicated during ordering process are estimated and can not be guaranteed.
5.2 In the event of an exceptionally long term of delivery AlfaVit shall inform the Customer about this by e-mail. The Customer has the right to cancel his order, if the item/title should be delivered within an exceptionally long term. AlfaVit retains the right to cancel a placed order if a title is out of print/out of stock, or it is exceptionally difficult to attain. In such a case the Customer will be offered a similar product to replace the out-of-stock one or the Customer may reserve the sum he has paid for future purchases.
5.3 Should an order include more than one item with different terms of delivery, the order will normally be despatched not until all items are ready for shipment. The delivery may, however, be divided into two or several parties at the discretion of the Customer service. In case of a mail delivery in several parties, the postage shall usually be charged only once (during the first shipment).
6. Liability (disclaimer)
AlfaVit assumes no liability whatsoever for any direct, incidental, consequential or indirect damage, arising to the Customer out of the product, non-acceptance of the order, or delay of shipment. Neither shall AlfaVit assume any liability whatsoever for the content of any material or resource in the periodical or any damage arising out of them, since such liability is on the manufacturer or the publisher. Similarly, all liability concerning copyright is on the manufacturer or the publisher.
7. Return Policy
7.1 According to the Polish Consumer Protection Act, any goods mailed to a private citizen may be returned within 14 days from the receipt. A returned item shall be essentially in the same condition as it was at the time of receipt.
7.2 Return policy in business-to-business shall be in compliance with the Polish Trade Law and fair trade usage. Any return shall be settled with our Customer service.
8. Claims
In the event of a mistaken delivery (wrong title or item with flaw or damage), the Customer shall notify AlfaVit as soon as possible. A damaged item shall, as a rule, be replaced by delivering a flawless item. If this is not possible, a discount or another item may be discussed to settle the matter.
9. Force majeure
AlfaVit shall not assume liability for non-delivery or delay of delivery of items, if caused by force majeure conditions (acts of God, calamities, strikes, terrorist acts, sabotage, suspension of traffic or energy supply, export or import prohibition, acts of government officials etc., which have significantly jeopardized the operations of AlfaVitn or its partners). AlfaVit will try to notify the Customer as soon as possible on the entry of such conditions into force.
10. Settlement of disputes
Disputes and conflicts concerning contracts and their conditions between AlfaVit and its Customers shall be settled primarily by amicable negotiations. If a settlement cannot be reached, the disputes may be via platform ODR (online dispute resolution): https://webgate.ec.europa.eu/odr
11. Copyright and Trade Mark Notice
The AlfaVit website and all images, text, audio and video and other materials appearing on the AlfaVit website (the Content), and its arrangement, are the property of AlfaVit, and are protected by international copyright and other laws. None of the Content may be copied, reproduced, transmitted or distributed without the prior permission of AlfaVit.
12. Intellectual Property
12.1 You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of your use of this website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors. Such permission will always be given in writing.
12.2 You acknowledge and agree that the material and content contained within this website is made available for your personal non-commercial use only and that you may only download such material and content for the purpose of using this website. You further acknowledge that any other use of the material and content of this website is strictly prohibited and you agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

14. Changes to Terms and Conditions of Use
AlfaVit reserves the right to add to or change these terms and conditions of use and agrees to ensure that a note of the date and clause number of any such amendments will be included as part of the conditions. Any changes will be posted to this page and it is the user’s responsibility to ensure that he/she is aware of any such changes. These will become effective 24 hours after first posting and users will be deemed to have accepted any change should they continue to access the AlfaVit after that time.
